Answer #2 Not sure if he has grounds to sue, but how the heck is it any of 1-800-Flowers
business if he is cheating or not? You would think they would do more business
if he was. Please let me clarify,I am NOT condoning what this guy did, but I
think it is very unprofessional of a company to even ask who the flowers were
for, let alone decide to out the guy. - answered by Rav
Answer #3 "He explicitly asked them not to send anything to his home, and they assured him
that wouldn’t happen. If his account is accurate, they proffered a service
– discretely delivering flowers – and they failed to deliver."YES he has
grounds to sue. - answered by Kitty
Answer #4 He should - answered by icraftyone
Answer #5 That's not the full story....He was legally separated when he sent the flowers.
He got back together sometime after the woman received them. The wife opened the
card that was sent to him by the florist stating something to the effect of
"thanks for the business". The wife got upset that he was dating while
separated, so filed for divorce. So yes he does he have the legal ground to
stand on. It was the florist that sent the card or letter which the wife opened,
she said bc it came from the florist (hoping it was a present). I'm not sure if
he'll win, but it was negligence on behalf of the florist that caused his wife
to divorce him. - answered by mrsprincess07
Answer #6 I don't know about the legalities of it, but he wouldn't be in this situation if
he hadn't been cheating. Some companies have other branches/departments, like
marketing or surveys, that are independent of the sales area. It could be this
is the kind of setup this company has. The person he talked to may not have
been in charge of the system that sends out the thank you cards for orders, or
it could be an automated process there is no control over.I think the guy should
drop the lawsuit and worry more about his marriage. He's probably going to need
the money to pay for his divorce lawyer. I hope both women drop him like a hot
brick. - answered by Greyhound Mama
Answer #7 Good one. I doubt if he has grounds. Did the florist send a bill to his home
and the wifey opened it or something? - answered by JUSTME
Answer #8 At 1-800-FLOWERS.COM, we take pride in creating relationships with our customers
by recognizing and thanking them for their business," the statement said. "We
take all matters relating to our customers seriously; however, we are not
responsible for an individual's personal conduct. Beyond this, it is the
company's policy not to comment on pending litigation and legal matters."That is
a statement 1800flowers made. They are right!!! I cant see how he will win
this. THE ARE NOT TO BLAME FOR HIS DIVORCE, HIS CHEATING IS TO BLAME FOR HIS
DIVORCE. Just like the note his wife gave him - his tmobile cell phone bill had
her number all over it too. Is he going to blame them and sue them for sending
him his bill??? - answered by outdrlvnnursingstdnt
Answer #9 Honestly don't care! - answered by gloria b
Answer #10 I heard this story too. I don't get it. If I remember correctly when he sent
the flowers his wife had already filed for divorce then they reconciled and then
a few months later the florist sent a thank you note?! OK, obviously he doesn't
care too much for his wife or he would've been sending her flowers to try to win
her back. Another thing I think is weird is I think I've used the same florist
and I've never gotten a thank you. But to answer your question he might. He
had explicitly told them not to send any type of correspondence and they did it
anyway. Is it a winnable case? Well somebody got rich because there coffee was
too hot so anything is possible. Is it right? No. - answered by Lostandconfused
Answer #11 Not in the least. And he's an idiot for thinking he does.Story for those who
haven't seen it:
http://www.star-telegram.com/news/story/199499.html"I'm not sure if he'll win,
but it was negligence on behalf of the florist that caused his wife to divorce
him."So his DATING had nothing to do with it, then? Please. At some point people
have to start taking responsibility for their own damned actions. - answered by Nandina
Answer #12 Probably, they should have refused to give any information on the transaction,
his privacy was violated. - answered by Donna J
Answer #13 A guy sued his dry cleaner for 54 million...lost...but is appealing...That woman
sued McDonald's because she spilled hot coffee on herself...Does it really
matter if there are any legal grounds to sue as long as there are lawyers
willing to take these cases....there will be the lawsuits.Don't sue me if you
don't like my answer, mmkay? - answered by Phil S
Answer #14 nope, the florist simply sent a thank you card to the house thanking him for his
business-the wife called them and asked for his most recent
transaction(different address) He cheated and he caught-boo, hoo! Sue a business
because you cheated? The florist didn't hold a gun to his head and say, "Cheat
or I'll shoot"-just some man trying to get over. - answered by bikinibabewannabe
Answer #15 People sue over stupid crap these days, and some win. So it doesn't really
suprise me. I guess it's worth a shot huh? I mean this guy probably lost his
wife over it, what has he got to loose? Maybe if he wins the million dollars she
will stay! LOL - answered by shaden
Answer #16 The answer is NO he does not, however his actions merely prove what I have been
saying for years, those that cheat are capable of the greatest selfishness; its
birth from selfishness. He is incapable of seeing his wrong doing, he looks to
others for the blame factor, thats why when ever a cheater is confronted with
their actions, they can rattle off all kinds of excuses, some similar to YOU
DROVE ME TO IT. thats why I have a simple rule about people like that, 1# when a
person reveals they have this kind of character, leave them and never ever give
them a second chance and never ever speak to them again, in an effect, UNKNOW
them.2# Never empower them with the words YOU CHEATED ON ME, merely recognize
all they did was REVEAL THEIR OWN TRUE CHARACTER and saved you more time to meet
someone who is not liken to them.I thinkwe should be allowed to Tatoo repeat
cheaters with the letter C and they should only be allowed to date one another
and when they see the C they can remember all the chances they had to know true
love from those of us who love the right way UNSELFISHLY, instead all they
should ever know is the same kind of love they are capable of giving and the C
will be their punishment for wasting the time of decent people.the nerve of that
jerk, goiing to sue an institution designed to show affection from the truely
affectoinate, not those who use such wonderful Ideals to hide treachery ! - answered by Daddy in a box :)
Answer #17 PLEASE! He needs to get over himself. He won't win, anyway... - answered by bahjij6
Answer #18 All I can say is please give me a break from the lunacy. If the guy is parading
around dropping flowers off at other women's homes, there are plenty of problems
there that don't remotely involve the florist. When in doubt, as many do, look
for a scapegoat. If their behavior is discovered, and it's poor, point to
someone else who is at fault. The florist in no way is accountable for this guy's
lack of character. If it was innocent and straight up, he should have disclosed
it. Sounds to me like it was covert and sneaky, and the discovery left him
red-faced. Time to point at someone else and divert attention away from the
scumbag behavior. - answered by The Beast
Answer #19 this brings great conversation because at the time he wasn't cheating he was
going through a divorce then him and his wife decided well lets work it out
then she gets thank thank you letter for your business and called them the
person whom answered that phone and clearly realized she was not him or the
woman whom received them flowers should be fired and yes he should sue them
because now hes getting a divorce 4 real and she wants triple the money now - answered by mother love
Answer #20 I don't know the law on how much protection against personal injury a business
should be held accountable for, that would be like making the florist keep your
secret when the truth is very present. If i were an attorney the guy would be
charged with the crime of causing another person to hold their secret which
could go against that person in the final outcome of things, because the person
should retain the right to confess and not hold another persons stone upon their
shoulder. If i were the judge hearing the case, it would be dismissed because of
the evidence against the patron. Stop the cover up! - answered by s7e7v7e7n7
Answer #21 I don't know if he has grounds...but he should be a man and accept his
consequences for cheating. Now...not only did he get to sleep around, HE'LL GET
PAID for his infidelity. What a loser.I just went back and read that he was
seeing someone while going through a divorce. That is irrelevant to me. He was
still MARRIED so therefore it was still cheating. Cheating has consequences. - answered by sloegin
